6.2 Any dispute relating to these terms is subject to the jurisdiction of the courts of the Republic of South Africa.
7. Links to other websites
7.1 This website may contain links to other sites. Unless expressly stated otherwise, those sites are not under the control of LDP Digital (Pty) Ltd or its affiliates.
7.2 We accept no responsibility for the content of those websites and disclaim liability for any loss or damage arising out of their use.
7.3 Including a link to another site does not imply any endorsement of that site or of those who control it.
8. Availability of the website, and disclaimers
8.1 Any online facility, tool, service or information that LDP Digital (Pty) Ltd makes available through this website (the service) is provided on an as is and as available basis. We give no warranty that the service will be free of defects or faults. To the maximum extent permitted by law we give no warranty, express or implied, of fitness for a particular purpose, accuracy of information, compatibility or satisfactory quality. We are under no obligation to keep the information on this website up to date.
8.2 While we take reasonable steps to keep this website secure and free of errors, viruses and other malware, we give no warranty or guarantee to that effect, and every User takes responsibility for their own security, that of their personal details, and that of their Computer.
8.3 We accept no liability for any disruption to, or non-availability of, this website.
8.4 We reserve the right to alter, suspend or discontinue any part of, or the whole of, this website, including but not limited to any product or service available on it. These terms continue to apply to any modified version of the website unless expressly stated otherwise.
8.5 No guarantee of marketing or commercial outcomes. Marketing carries commercial risk. What any campaign, website or strategy returns depends on factors we do not control — your market, your pricing, your capacity, how your team follows up, and the advertising platforms themselves. Nothing on this website is a guarantee of leads, rankings, traffic, revenue or any other outcome. Figures, case studies and examples describe results achieved for specific clients under their own conditions; they are illustrations of what the method has done, not a promise of what it will do for you. Any forecast, projection or estimate we give is a direction of travel based on the information available at the time, and is not a commitment to a number.
9. Breaches of these terms
9.1 Without prejudice to our other rights under these terms, if you breach these terms in any way, or we reasonably suspect that you have, we may:
- send you one or more formal warnings;
- temporarily suspend your access to the website;
- permanently prohibit your use of the website;
- block any Computer using your IP address from accessing the website;
- commence legal action against you.
9.2 If we suspend, block or prohibit your use of the website or any part of it, you must not take any action to circumvent that suspension, prohibition or block.
10. Limitation of liability
10.1 Nothing in these terms will limit or exclude:
- our or your liability for death or personal injury resulting from our or your negligence, as applicable;
- our or your liability for fraud or fraudulent misrepresentation;
- any of our or your liabilities in any way that is not permitted under applicable law.
10.2 We will not be liable to you for any loss arising out of events beyond our reasonable control.
10.3 To the maximum extent permitted by law, LDP Digital (Pty) Ltd accepts no liability for any of the following:
- business losses, such as loss of profit, income, revenue, anticipated savings, business, contracts, goodwill or commercial opportunity;
- loss or corruption of any data, database or software;
- any special, indirect or consequential loss or damage.
11. General
11.1 You may not transfer any of your rights under these terms to another person. We may transfer our rights under these terms where we reasonably believe your rights will not be affected.
11.2 These terms, together with the privacy and cookies provisions set out below, contain the whole agreement between the parties relating to their subject matter, and supersede all prior discussions, arrangements or agreements relating to them.
11.3 If any court or competent authority finds that any provision of these terms, or part of any provision, is invalid, illegal or unenforceable, that provision or part-provision will, to the extent required, be deemed deleted, and the validity and enforceability of the remaining provisions will not be affected.
12. Pricing
12.1 LDP Digital (Pty) Ltd endeavours to offer competitive prices on current products and services.
12.2 We reserve the right to alter pricing at any time without prior notice.
12.3 Where a price is displayed with a product or service, that price applies. During a sale or special offer, the discounted price is displayed for the duration of that sale or offer.
12.4 We make all reasonable efforts to maintain correct prices. If an error occurs and an item is offered at an incorrect price, we are not obliged to supply it at that price.
12.5 Unless stated otherwise, prices shown on this website exclude VAT and exclude delivery.
12.6 Installations, packages and premiums shown on this website are for display purposes and may differ from what is offered to you.
13. Revisions to these terms
13.1 We reserve the right to update these terms.
13.2 The revised terms apply to use of this website from the date they are published on it.
13.3 You waive any right you might otherwise have to be notified of, or to consent to, revisions of these terms.
13.4 If we do send you notice of a change to these terms, the change applies from the date you received that notice. If you do not agree with the revision, you must stop using the website.
14. Privacy policy
14.1 What you give us. When you complete a form on this website we ask for information including your name, surname, email address, telephone number, business name, and whatever you tell us about how we can help. Some forms ask a small number of qualifying questions, such as your current monthly marketing spend. You choose what to send.
14.2 What the site records on its own. Separately from anything you type, this website keeps its own record of how it is used: the pages viewed and in what order, how far down a page you read, how long you stayed, which buttons and links were clicked, where you arrived from, and the campaign and click identifiers that advertising platforms attach to a link when you arrive from an advertisement. To hold that together across visits we set a first-party identifier on your browser. No third party is involved in this record and it is not sold.
14.3 Why we keep it. To answer your enquiry, to understand which of our own pages and campaigns lead to real enquiries, to improve the website, and to measure our own advertising. Where you have asked us to, we also use your details to send you marketing communication.
14.4 The lawful basis. Where you complete a form, we process what you send in order to respond to you and, where relevant, to take steps towards a contract. The site’s own usage record is processed on the basis of our legitimate interest in measuring and improving our own website and advertising, as provided for in section 11(1)(f) of the Protection of Personal Information Act, 2013 (POPIA). This is set out here as required by section 18 of that Act, and you have the right to object — see section 17 below.
14.5 The advertising choice is separate. The cookie bar on this site governs whether Google, Meta and LinkedIn may set cookies and receive data for advertising measurement. Declining keeps those third-party cookies off and stops data being sent to those platforms. It does not stop our own first-party record described in 14.2, which continues either way. If you want that stopped as well, section 17 tells you how.
14.6 Who sees it. Your information is held behind secured networks and is accessible only to a small number of people who need it and who are required to keep it confidential. Enquiries submitted through this website are passed to our customer relationship management system through an automation service, so that the enquiry reaches the person who will answer it.
14.7 Who it is not given to. We do not sell, trade or otherwise transfer your personal information to outside parties. This does not include website hosting partners, automation and email providers, and other parties who assist us in operating this website or in serving you, provided they agree to keep the information confidential.
14.8 How long we keep it. Enquiry records and the site’s usage record are kept for as long as they remain useful to the purposes above, which in practice means indefinitely, unless you ask us to delete them. We will in any event retain and use information to the extent necessary to comply with our legal obligations, resolve disputes and enforce our agreements and policies. We may keep anonymous, aggregated figures for statistical purposes after a deletion request.
14.9 Security. This website is scanned regularly for security holes, known vulnerabilities and malware, so that your visit is as safe as we can reasonably make it.
14.10 Disclosure required by law. We may release your information where we believe it is appropriate in order to comply with the law, to enforce our site policies, or to protect our rights, property or safety, or those of others, including in response to a valid request by a public authority such as a court or government body.
14.11 Information crossing borders. Information you share with us may be transferred to, and held on, computers located outside your province, country or other jurisdiction, where data protection laws may differ from those of your own. We take the steps reasonably necessary to ensure that it is treated securely and in accordance with this policy.
14.12 Change of ownership. If we are involved in a merger, acquisition or sale of assets, your personal information may be transferred. We will give notice before it is transferred and becomes subject to a different privacy policy.
14.13 Other websites. We may link to third-party sites. Those sites have their own, independent privacy policies, and we have no responsibility or liability for their content or activities. We do aim to protect the integrity of this website and welcome any feedback about the sites we link to.
15. Service providers, analytics and advertising
15.1 We use third-party companies and individuals to help us run this website, to provide parts of it on our behalf, and to help us understand how it is used. These providers have access to your personal information only to perform those tasks on our behalf, and are obliged not to disclose it or use it for any other purpose.
15.2 Google Analytics and Google Tag Manager. Google Analytics reports how visitors behave on this website. Google uses the data it gathers to track and report that behaviour, and may combine it with other Google services. You can prevent Google Analytics collecting your activity by installing the Google Analytics opt-out browser add-on. Google’s own privacy terms are published at policies.google.com/privacy.
15.3 Google Ads. Where advertising measurement is permitted, Google Ads records that an advertisement click led to an enquiry, and may build remarketing audiences. Advertising personalisation can be switched off in your Google account settings.
15.4 Meta (Facebook and Instagram). Where advertising measurement is permitted, the Meta Pixel reports the same kind of information to Meta, which may use it within its own advertising network. You can adjust advertising preferences within Facebook itself; doing so may not prevent Meta gathering data about your behaviour. Meta’s privacy terms are published at facebook.com/policy.php.
15.5 LinkedIn. Where advertising measurement is permitted, the LinkedIn Insight Tag reports website activity to LinkedIn for campaign measurement and audience building. LinkedIn members can control this in their LinkedIn advertising settings.
15.6 If you decline on the cookie bar, the tags described in 15.2 to 15.5 either do not run or run without storing anything on your device, and identifiers are withheld from those platforms.
16. Cookies
16.1 As is common practice on almost every website, this site uses cookies. Cookies are small files stored on your Computer that let a site recognise a browser between page views.
16.2 Cookies we set ourselves. A visitor identifier that lets us recognise a returning browser and link a visit to an earlier one; a record of where you first arrived from and where you most recently arrived from, including advertising click identifiers; a record of your answer to the cookie bar, so that it stops asking; and a short-lived, per-visit token held only until you close the tab. WordPress also sets strictly necessary cookies for logged-in administrators, and the hosting and security layer may set its own.
16.3 Cookies set by others. Google Analytics, Google Ads, Meta and LinkedIn each set their own cookies where the cookie bar allows it. These are governed by those companies’ policies, not ours.
16.4 Turning them off. There is no industry-standard way to disable cookies without affecting the features they support. You can block or delete cookies in your browser settings. If you are unsure whether a cookie supports something you use, we recommend leaving it on.
17. Your rights, and how to use them
17.1 Under POPIA you may ask us what personal information we hold about you, ask us to correct it, ask us to delete it, object to our processing it, and withdraw consent you have given for marketing communication.
17.2 To object to the site’s own usage record described in 14.2, email us at scale@ldp.digital with the word OBJECT in the subject line, or use the form on the Contact page and say so. We will stop that collection for you and delete the rows already held against your browser. You do not have to give a reason.
17.3 To ask what we hold, to correct it, or to have it deleted, use the same routes. We will answer, and where we have to keep something for a legal reason we will tell you what and why.
17.4 To stop marketing communication, use the unsubscribe link on any message we send, or reply and ask.
17.5 To change the advertising choice made on the cookie bar, clear this site’s cookies in your browser and answer the bar again.
17.6 If you are not satisfied with how we have handled a request, you may lodge a complaint with the Information Regulator of South Africa, whose details are published at inforegulator.org.za.
17.7 Our manual prepared under the Promotion of Access to Information Act, 2000 (PAIA), which sets out the records we hold and how to request access to them, is published at ldp.digital/paia-manual.
